Privacy policy

This Privacy Policy describes how Copan Diagnostics, Inc., a New York corporation (“we”), collect, use, and disclose information when you visit or make a purchase from copan-diagnostics-inc.myshopify.com (the “Site”).

By accessing or using the Site, you consent to this Privacy Policy.  If you do not agree with this Privacy Policy, please do not access or use the Site.  Information gathered through the Site may be transferred, used, and stored in the United States or in other countries where our service providers or our affiliates are located.  If you use the Site, you agree to the transfer, use, and storage of your Personal Information (as defined below) in those countries. The data protection and other laws of the United States and other countries might not be as comprehensive as those in your country. You agree that all transactions relating to the Site are deemed to occur in the United States, where our servers are located.

This Privacy Policy applies to information we collect through the Site, as well as other information provided to us online or offline by third parties, when we associate that information with customers or users of the Site; however, it does not apply to information collected from our employees, contractors, or vendors.  It also does not apply to information that you ask us to share with third parties or is collected by Online Tool Providers (as further described below).  You acknowledge and agree that we are not responsible for the data collection or use practices of any other user of the Site or a third party utilized in providing the Site. 

Collecting Personal Information

When you visit the Site, we collect certain information about your device, your interaction with the Site, and information necessary to process your purchases. We may also collect additional information if you contact us for customer support or sign up for our newsletter. In this Privacy Policy, we refer to any information that can uniquely identify or reasonably be linked to an individual (including the information below) as “Personal Information”. See the list below for more information about what Personal Information we collect and why.

Device information

  • Examples of Personal Information collected:version of web browser, IP address, time zone, cookie information, what sites or products you view, search terms, and how you interact with the Site.
  • Purpose of collection:to load the Site accurately for you, and to perform analytics on Site usage to optimize our Site.
  • Source of collection:Collected automatically when you access our Site using cookies, log files, web beacons, tags, or pixels.
  • Disclosure for a business purpose:shared with our processor Shopify.

 

Order information

  • Examples of Personal Information collected:name, billing address, shipping address, payment information (including credit card numbers), email address, and phone number.
  • Purpose of collection:to provide products or services to you to fulfill your order, to process your payment information, arrange for shipping, and provide you with invoices and/or order confirmations, communicate with you, screen our orders for potential risk or fraud, and when in line with the preferences you have shared with us, provide you with information or advertising relating to our products or services, such as our newsletter.
  • Source of collection:collected from you.
  • Disclosure for a business purpose:shared with our processor Shopify, COPAN internal sales channels, and shipping vendors (UPS, FedEx, etc.).

 

Customer support information

We also collect non-Personal Information relating to the Site, that is, information that does not personally identify an individual (“Non-Personal Information”), such as certain technical information about your use of the Site.  We will not use Non-Personal Information to try to identify you, and if we associate any Non-Personal Information with information that personally identifies you, then we will treat it as Personal Information.

Sharing Personal Information

We do not sell your Personal Information but we may disclose your Personal Information to third parties as described below.  

We may disclose Personal Information to provide the Sites, or when you authorize or instruct us to do so, for example when you use the Sites to submit content or profile information. We may also disclose Personal Information and Non-Personal Information to Service Providers and to our affiliates, which are companies directly or indirectly controlling, controlled by or under common control with us.  By “Service Providers” we mean companies, agents, contractors, service providers, or others engaged to perform functions on our behalf (such as processing of payments, provision of data storage, hosting of our website, marketing of our products and services, and conducting audits).   When we use a Service Provider, we require that the Service Provider use and disclose the Personal Information and Non-Personal Information received from us only to provide their services to us or as required by applicable law.

 

We may also disclose Personal Information and Non-Personal Information to Online Tool Providers.  By “Online Tool Provider” we mean a licensor of software that we include in, or use with, the Sites, including an API or SDK, that provides a specialized function or service to us and that requires the transmission of Personal Information and/or Non-Personal Information to the Online Tool Provider.  Online Tool Providers may have the right to use Personal Information and Non-Personal Information about you for their own business purposes.  Use and disclosure of Personal Information and Non-Personal Information by an Online Tool Provider is described in its privacy policy.  For example:

We also share your Personal Information in connection with Behavioral Advertising, as provided below.

We may also disclose your Personal Information to third parties when we believe, in good faith and in our sole discretion, that such disclosure is reasonably necessary to (a) enforce or apply the terms and conditions of the Sites, including investigation of potential violations thereof, (b) comply with legal or regulatory requirements or an enforceable governmental request, (c) protect the rights, property or safety of us, our users or other third parties, (d) prevent a crime or protect national security, or (e) detect, prevent or otherwise address fraud, security or technical issues. 

We reserve the right to transfer information (including your Personal Information) to a third party in the event of a sale, merger, or transfer of all or substantially all of the assets of our company relating to the Sites, or in the unlikely event of a bankruptcy, liquidation, or receivership of our business. We will use commercially reasonable efforts to notify you of such transfer, for example via email or by posting notice on our website.

Lastly, we may also disclose Non-Personal Information, aggregated with information about our other users, to our clients, business partners, merchants, advertisers, investors, potential buyers and other third parties if we deem such disclosure, in our sole discretion, to have sound business reasons or justifications.  

BEHAVIOURAL ADVERTISING

As described above, we use your Personal Information to provide you with targeted advertisements or marketing communications we believe may be of interest to you. For example:

Using Personal Information

We use your Personal Information to:

  • Assist us in providing, maintaining, and protecting the Sites;
  • Set up, maintain, and protect accounts to use the Sites;
  • Improve our online operations;
  • Process transactions;
  • Provide customer service;
  • Communicate with you, such as provide you with account- or transaction-related communications, or other newsletters, RSS feeds, and/or other communications relating to the Sites;
  • Send or display offers and other content that is customized to your interests or preferences;
  • Perform research and analysis aimed at improving our products and services and developing new products or services; and
  • Manage and maintain the systems that provide the Sites.

 

RETENTION

When you place an order through the Site, we will retain your Personal Information for our records until you ask us to erase this information or we no longer have a business purposes for this information.  For example, we may retain your Personal Information for audit or support purposes.  

You may request that we not contact you for marketing purposes by emailing us at customerservice@copanusa.net.  You can also opt out of receiving marketing e-mails from us by clicking on the “unsubscribe” link in the e-mails.  Please note that it may take up to ten (10) business days for your opt-out request to be processed.  Also, even if you opt out of marketing e-mails, we may continue to send you certain account-related e-mails, such as notices about your account and confirmations of transactions you have requested.

 

AUTOMATIC DECISION-MAKING

If you are a resident of the EEA, you have the right to object to processing based solely on automated decision-making (which includes profiling), when that decision-making has a legal effect on you or otherwise significantly affects you.

We DO NOT engage in fully automated decision-making that has a legal or otherwise significant effect using customer data.

Our processor Shopify uses limited automated decision-making to prevent fraud that does not have a legal or otherwise significant effect on you.

Services that include elements of automated decision-making include:

  • Temporary denylist of IP addresses associated with repeated failed transactions. This denylist persists for a small number of hours.
  • Temporary denylist of credit cards associated with denylisted IP addresses. This denylist persists for a small number of days.

Cookies

A cookie is a small amount of information that’s downloaded to your computer or device when you visit our Site. We use a number of different cookies, including functional, performance, advertising, and social media or content cookies. Cookies make your browsing experience better by allowing the website to remember your actions and preferences (such as login and region selection). This means you don’t have to re-enter this information each time you return to the site or browse from one page to another. Please note that because there is no consistent industry understanding of how to respond to “Do Not Track” signals, we do not alter our data collection and usage practices when we detect such a signal from your browser.

 

Information Security

We utilize reasonable information security measures to safeguard your Personal Information against unauthorized access, modification, or destruction.  For example, we utilize Secure Socket Layer (SSL), Transport Layer Security (TLS), or similar encryption technology when sensitive data is transmitted over the Internet, and use firewalls to help prevent external access into our network.  However, no data transmission over the Internet and no method of data storage can be guaranteed to be 100% secure.  Therefore, while we strive to use commercially acceptable means to protect your Personal Information, we cannot guarantee its security.

We restrict access to Personal Information in our possession to our employees, Service Providers, and Online Tool Providers who need to know that information in order to operate, develop, improve or support our Sites. If we share Personal Information with Service Providers or Online Tool Providers, we require that they also use reasonable information security measures to safeguard your Personal Information.

 

RIGHTS AVAILABLE TO CALIFORNIA RESIDENTS

Under the CCPA, residents of California are provided with certain rights regarding their Personal Information (as defined in the CCPA). The following section outlines these rights:

 

  1. Right to Know: You have the right to request that we disclose certain information to you about our collection and use of your Personal Information over the past 12 months. Once we receive and confirm your verifiable consumer request, we will disclose to you:
  • the Categories of Personal Information we have collected from you
  • the business purposes for which such Personal Information was collected
  • the Sources of Personal Information we have collected from you
  • the specific pieces of Personal Information stored about you
  • the categories of 3rd parties with whom we share Personal Information
  • If we shared your Personal Information for a business purpose, the categories of Personal Information that each category of recipient obtained.
  1. Right to Request Deletion: You have the right to request deletion of your Personal Information that has been collected and retained from you subject to certain exceptions. Once we receive and confirm your verifiable consumer request, we will delete your Personal Information from our records, unless there is an applicable exception. We may deny your deletion request if we need to retain the information to:
  2. Complete the transaction for which we collected the Personal Information, provide a good or service that you requested, take actions reasonably anticipated within the context of our ongoing business relationship with you, or otherwise perform our contract with you.
  3. Detect security incidents, protect against malicious, deceptive, fraudulent, or illegal activity, or prosecute those responsible for such activities.
  4. Debug products to identify and repair errors that impair existing intended functionality.
  5. Exercise free speech, ensure the right of another consumer to exercise their free speech rights, or exercise another right provided for by law.
  6. Comply with the California Electronic Communications Privacy Act (Cal. Penal Code § 1546 ).
  7. Engage in public or peer-reviewed scientific, historical, or statistical research in the public interest that adheres to all other applicable ethics and privacy laws, when the information's deletion may likely render impossible or seriously impair the research's achievement, if you previously provided informed consent.
  8. Enable solely internal uses that are reasonably aligned with consumer expectations based on your relationship with us.
  9. Comply with a legal obligation.
  10. Make other internal and lawful uses of that information that are compatible with the context in which you provided it.

If none of the foregoing exceptions applies, and we delete the information in compliance with your verifiable request, we will also direct our applicable service providers to delete your personal information.

You or an authorized agent registered with the California Secretary of State that you authorize to act on your behalf, may exercise the Rights twice in a 12-month period. Your verifiable request must include sufficient detail for us to understand, evaluate, and respond to it.  It must also provide sufficient information that allows us to reasonably verify that you are the individual about whom we have collected Personal Information or an authorized agent representing the individual.  Please note that in some cases we may need to obtain information from you as part of the verification process to verify your identity to a reasonable degree.  We may require you to provide Personal Information as part of the verification process.  For authorized agents, we may require a signed, written authorization, a notarized affidavit, or a valid power of attorney.  We will only use this information for the purpose of verifying the requestor’s identity or authority.  To exercise these rights, please call us at 1-800-216-4016 or email us at privacy@copanusa.net.

We will acknowledge your right to know or deletion request within ten (10) business days of receipt, and provide information about how we will process the request.  In many cases we will respond to your request within 45 days.  In some cases we may extend the time to respond for another 45 days.  If this extension is necessary, we will give you notice and the reason that we need the additional time to respond.

If we are unable to verify your identity or your authority to make the request within 45 days, we cannot fully respond to you and may deny your request.  We may treat the deletion request as an opt-out request.  For requests seeking specific pieces of information, we will treat it as a request for the disclosure of the categories of Personal Information about the consumer.

We retain records of your requests, including the request data, nature of the request, manner of submission, the response and any basis of denial for a period of 24 months.

We will not discriminate against you in terms of services, the level or quality of services, or pricing for exercising any of your CCPA rights. If there are excessive requests, we may charge a reasonable fee as permitted under the CCPA.

RIGHT TO OPT-OUT OF DATA SALES FOR NEVADA RESIDENTS

We do not sell your covered information, as defined by Section 603A.320 of the Nevada Revised Statutes.  If you reside in Nevada, you have the right to submit a request to us at privacy@copanusa.net regarding the sale of covered information.  Please include "Nevada" in your email subject line, and include the following information in your email: your name, Nevada resident address, and email address.  We will respond within sixty (60) days of receiving your request.

 Changes

We may update this Privacy Policy from time to time in order to reflect, for example, changes to our practices or for other operational, legal, or regulatory reasons.  If we make any material changes to this Privacy Policy, we will notify you by reasonable means, which may be by e-mail or posting a notice of the changes on our website  prior to the changes becoming effective.  We encourage you to check this Privacy Policy from time to time.  IF YOU DO NOT AGREE TO CHANGES TO THIS PRIVACY POLICY, YOU MUST STOP USING THE SERVICES AFTER THE EFFECTIVE DATE OF SUCH CHANGES (WHICH IS THE “LAST UPDATED” DATE OF THIS PRIVACY POLICY).
